WLC Program Affiliate Program in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the WLC Program Affiliate Program, with no refund.

You are in no way allowed to add email addresses to any mailing list without getting approval from the email address owner. The owner of the email address must confirm a subscription and must opt in to receive emails from you. If you do not get permission from the email address owner, this is defined as SPAM under the WLC Program Affiliate Agreement.

You hereby acknowledge and agree to abide by the following restrictions regarding marketing communications when you engage in affiliate marketing for Weight Lifting Complete.

You must not post messages to Usenet, forums and message boards that are unrelated to the topic of discussion, cross-posted to unrelated newsgroups, posted in excessive volume, or posted in against forum or message board rules. You further agree that it is your responsibility to make yourself aware of any forum or message board rules.

You must not post content on free blog websites, especially multiple blog websites, that are not updated and that are used for the sole purpose of keyword spamming, or post comments on legitimate blogs that violate the comment policy of the blog owner. You further agree that it is your responsibility to make yourself aware of any blog rules or policies.

You must not post solicitations in chat rooms, or to groups or individuals via Internet Relay Chat or "Instant Messaging" systems (such as ICQ).

You must not engage in certain offline activities, that may not considered spam but are similar in nature, including distributing flyers or leaflets on private property or where prohibited by applicable rules, regulations, or laws.

You agree and consent to receive e-mail from Weight Lifting Complete and ClickBank, including but not limited to, sales reports, training, promotional resources, newsletters and other correspondence.

DAMAGES DUE TO VIOLATION OF THIS AGREEMENT

Because damages are often difficult to ascertain, if actual damages cannot be reasonably calculated then You agree to pay Weight Lifting Complete liquidated damages of $500 for each piece of spam or unsolicited e-mail transmitted from or otherwise connected with your account, or actual damages, whichever is higher, to the extent such actual damages can be reasonably calculated.

You will indemnify, defend, and hold harmless Weight Lifting Complete and its officers, directors, employees and agents (the "Indemnified Parties") from any claim, demand or other legal process or proceeding, including without limitation as to legal costs and fees, arising from or alleging facts that, if true, would constitute breach of this Agreement or any of the representations and warranties contained herein. The Indemnified Parties have the right, but not the obligation, to participate through counsel of their choice in any defense by you required by this Section 8. You may not settle any claim against any Indemnified Party without their prior written consent.

DISCLAIMER

We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the (Insert Your Affiliate Program Name Here) Affiliate Program. In addition, we make no representation that the operation of our site, Clickbank's Site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or down time.

This Agreement will be governed by the laws of the United States and the District of Columbia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the Federal or State courts located in Simpsonville, KY, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By reading (or not reading if you decide to ignore this agreement) this Affiliate Agreement Page, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.

Please note that NO COMMISSION is paid on your original purchase of the WLC Program. In other words you cannot buy from yourself or be your first purchase for the sole purpose of discounting your own product purchase.
